Supreme Court To Decide Whether Total Secrecy Is Maximum Transparency

The Supreme Court agreed Tuesday to consider whether Elon Musk’s Department of Government Efficiency achieved “maximum transparency” by preventing the public from inspecting evidence of its work. The case arose from a Freedom of Information Act request by Citizens for Responsibility and Ethics in Washington seeking records about DOGE’s structure, federal firings, canceled contracts and access to sensitive government systems. The Trump administration maintains that DOGE was merely an advisory body, albeit one whose casual suggestions caused employees to lose their jobs, contracts to disappear and agencies to begin packing their belongings.

Arguments are expected in early 2027, giving the administration additional time to prove its commitment to openness by keeping the relevant material closed. “Nobody has ever been more transparent than DOGE, because there is nothing to see, and when the American people see nothing, they are seeing absolutely everything,” President Donald Trump said, resolving the dispute for anyone who regards information as an obstacle to knowledge. Musk’s pledge of “maximum transparency” was fulfilled through a disciplined program of withholding documents, limiting oversight and ensuring that any organizational chart remained safely beyond the reach of organized citizens.

Administration officials warned that releasing DOGE records could expose Americans to dates, names, email messages and other gateway materials commonly associated with accountability. The justices must now decide whether courts may examine DOGE’s activities to determine whether those activities may be examined, a streamlined legal process in which the government proves it exercised no authority by withholding all evidence that it exercised authority. Under the administration’s theory, an entity becomes more transparent as it reveals less, reaches perfect transparency when it reveals nothing and attains democratic legitimacy once nobody can identify who made the decisions. DOGE therefore remains the most transparent operation in federal history because the public cannot see it at all.
