Biden Grapples with Rare 14th Amendment Challenge
Congress is considering employing the 14th Amendment against President Joe Biden. This seldom-used amendment, typically relegated to theoretical political discourse, is being brandished as a formidable threat to the current administration.
Republican legislators argue that Biden’s recent executive orders have breached constitutional limits, thus necessitating a review under the 14th Amendment. This amendment, for those not versed in governmental law, contains a clause that prohibits any officeholder from continuing in their role if they have “engaged in insurrection or rebellion”.
“President Biden’s actions are a stark departure from our constitutional principles,” stated Senator Ted Cruz. “The way he is using executive orders to infringe upon states’ rights constitutes a rebellion against the Constitution.”
Democrats, unsurprisingly, have dismissed this move as political posturing. House Speaker Nancy Pelosi responded, “This is simply a diversion tactic by the Republicans to draw attention away from their lack of a unified plan.”
While the term “insurrection” generally brings to mind images of violent revolt, Republicans maintain that Biden’s actions can be construed as such in a more figurative sense. It is well-known that political interpretation often takes precedence over literal definition.
However, experts have expressed doubt about the likelihood of this move being successful. Constitutional scholar, Laurence Tribe, observed, “The 14th Amendment was designed to handle the fallout of the Civil War, not minor political disputes. Applying it in this scenario is like using a steamroller to crack a nut.”
