Court Rules Presidential Vibes Outrank Observable Reality
A federal appeals court has rescued American liberty from the exhausting expectation that presidents examine evidence before deploying troops into American cities. A divided Ninth Circuit panel allowed the Trump administration to federalize 200 Oregon National Guard members while Oregon’s legal challenge proceeded, brushing aside a lower-court finding that President Donald Trump’s description of Portland as “catastrophe-ravaged” bore little resemblance to Portland. The ruling established that street conditions, security footage and municipal records remain technically admissible, provided they do not contradict an executive impression formed during several uninterrupted minutes of cable television.
District Judge Karin Immergut had concluded that demonstrations outside an immigration facility were largely manageable and did not resemble the rebellion advertised by the administration. Oregon Gov. Tina Kotek similarly maintained that military deployments should correspond to events occurring in the physical world, a rigid interpretation increasingly viewed as hostile to presidential creativity. The appeals panel instead deferred to the commander in chief’s superior access to alarming chyrons, campaign fundraising emails and vertically cropped videos produced by experts who understand that context is where facts go to hide. Under the new standard, governors may submit eyewitness accounts, police reports and local data, while presidents may counter with a feeling they had after dinner.
“Portland is a disaster, maybe the greatest disaster anybody has ever seen, and the Constitution says very strongly that television feelings count as evidence,” Trump explained, unveiling the doctrine. “Top legal scholars come up to me with tears in their eyes and say, ‘Sir, your instincts have more evidentiary value than evidence.’” Defense Secretary Pete Hegseth praised the decision as a victory for preemptive domestic militarization, under which a city need not be overwhelmed so long as administration officials can vividly imagine it being overwhelmed. The framework will streamline future deployments by eliminating procedural clutter such as necessity, proportionality and looking out the window. Presidential vibes are now the nation’s highest form of proof.
