Trump Administration Reclassifies Court Orders As Optional Guidance

A federal judge ruled Tuesday that the Trump administration violated a nationwide injunction by finalizing a Postal Service regulation restricting mail voting, formally confirming that court orders are optional reading for presidents occupied with television, golf and the restoration of executive monarchy. Judge Indira Talwani declined to impose sanctions, preserving the administration’s constitutional right to face no consequences while determining which other judicial commands were merely suggestions printed on expensive stationery.

The regulation would prevent the Postal Service from mailing ballots to voters absent from federally assembled citizenship lists. Although the rule may be published, it cannot be implemented while Talwani’s injunction remains in effect, an arrangement White House officials described as complete compliance because the forbidden policy has only been written, finalized and prepared for use. “Nobody respects injunctions more than I do, but an injunction is really just a judge’s opinion written down very strongly, and presidents have much stronger pens,” President Donald Trump said. “We finalized the rule without implementing it, which means we violated nothing while accomplishing everything, a legal achievement perhaps greater than the Constitution.” Administration lawyers said this doctrine allows the government to disregard an order up to the precise moment a judge notices.

The League of Women Voters asked Talwani to enforce her earlier injunction after officials completed the regulation despite being told not to complete it. Talwani found that the administration could not plausibly claim confusion, recklessly reviving the obsolete legal principle that words retain their meanings after entering the White House. Officials nevertheless celebrated the ruling as a decisive victory, noting that the judge identified a violation but failed to attach any unpleasant result to it. Under the administration’s updated constitutional framework, courts remain free to issue injunctions, findings and stern expressions of concern, provided everyone recognizes them as decorative certificates honoring presidential initiative. Judicial oversight is now a customer-service survey the president has already declined to complete.
